If Purchaser elects not to purchase the Property, Purchaser shall deliver to Seller within thirty (30) days copies of the following third-party studies or any other third-party studies that Purchaser may have obtained relating to the Property: boundary, topographic or ALTA surveys; geotechnical reports; Phase I and II Environmental Site Assessments; all permit applications; traffic studies; and any other materials related to the development of the Property.
Buyer has the right to obtain environmental inspections of the Property 507 including Phase I and Phase II Environmental Site Assessments, as applicable.
The City and its agents, including but not limited to consultants, surveyors, engineers, home inspectors, appraisers, and other professionals hired by the City, shall have the right to access the Property to conduct environmental studies (including but not limited to Phase I and Phase II Environmental Site Assessments), structural inspections, sewer and septic system sampling, asbestos and lead testing, and any other due diligence the City deems necessary.
To the City’s Actual Knowledge, the City has delivered copies, or otherwise made available, to Developer all Environmental Site Assessments in City’s possession as of the date hereof.
Seller Buyer will order or provide Phase I Environmental Site Assessment, Phase II Environmental Site Assessment (compliant with most current version of the applicable ASTM E1527standard practices for Environmental Site Assessments) and/or Asbestos, at the expense of Seller Buyer (Environmental Inspection).
