Equipment and Materials means all materials, supplies, apparatus, device, machinery, equipment, parts, tools, special tools, components, construction utilities, instruments, appliances, spare parts and appurtenances thereto that are (i) required for the construction of the Gathering System in accordance with Prudent Industry Standards, including to the extent required so that the Gathering System is capable of operating in accordance with Prudent Industry Standards; or (ii) described in, required by, or reasonably inferable from the Work as described herein.

Equipment and Materials means all goods, equipment, stock, machinery, apparatuses, components, subcomponents, items, elements, materials, reports, data, presentations, documents, software, materials, and any other assets or ítems (in any format) provided by the Supplier or on its behalf to ScottishPower under and/or pursuant to the Contract, including (without limitation) those items detailed in the Technical Specification or in any other part of the Contract.

• For the avoidance of doubt, ordering, delivery, inspection and acceptance of Equipment and Materials & Consumables are required to occur in the same Fiscal Year to be covered by the Research Fund.

• Therefore, except for the supply of Owner Furnished Equipment and Materials and performance of the Owner Scope of Work, any item indicated herein, inferable therefrom, incidental thereto or required in accordance with any Law, Permits or Applicable Codes and Standards is to be considered as part of the Work.
