Excess Charges definition

Excess Charges means any amount of rent charged in respect of a tenancy of an Affordable Rental Unit that is in excess of Permitted Rent, plus any fees or charges of any nature whatsoever that are charged in respect of the tenancy of an Affordable Rental Unit that are not Permitted Tenant Charges, and includes all such amounts charged in respect of any tenancy since the commencement date of the Tenancy Agreement in question, irrespective of when the City renders an invoice in respect of Excess Charges;
Excess Charges means the applicable excess copies and/or prints charges. “Inception Date” means (a) the date Dealer determines Equipment installed by Dealer is operating satisfactorily and is available for your use, or (b) the date Equipment identified by Dealer as being installable by you is delivered to your premises. “Lease” means this Cost Per Copy Agreement, including any attached Equipment schedule. “Lease Payment” means the Monthly Lease Payment specified above, which includes the fixed component of maintenance charges payable to Dealer under the Maintenance Agreement, the Excess Charges (unless otherwise agreed by you, Dealer and XFS), and other charges you, Dealer and XFS agree will be invoiced by XFS on a monthly basis, plus Taxes. “Maintenance Agreement” means a separate agreement between you and Dealer for maintenance and support purposes. “Origination Fee” means a one-time fee of $125 billed on your first invoice which you agree to pay, covering the origination, documentation, processing and certain other initial costs for the Lease. “Term” means the Initial Lease Term plus any subsequent renewal or extension terms. “UCC” means the Uniform Commercial Code of the State of Connecticut (C.G.S.A. §§42a-1-101 et seq.).
Excess Charges means those additional charges that may be applicable to a Service Instance and that shall not exceed the maximum amounts set out in the “Excess Charges” table on the “Misc Services” tab of the Pricing Model referenced in Part B of Call Off Schedule 3 (Call Off Contract Charges, Payment and Invoicing);

  • The Excess Charges are due and payable five (5) business days following receipt by the Owner of an invoice from the City for the same.

More Definitions of Excess Charges

Excess Charges mean the applicable excess image/print charges on a Cost per Image Schedule. “Interim Period” means the period, if any, between the Acceptance Date and the Commencement Date. “Interim Payment” means one thirtieth of the Payment multiplied by the number of days in the Interim Period. “Payment” means the periodic Lease or Base Payment specified in one or more Schedules, which includes Taxes and other charges you, Supplier and XFS agree will be invoiced by XFS, and may include the fixed component of maintenance charges payable to Supplier under the Maintenance Agreement and Excess Charges (unless otherwise agreed by you Supplier and XFS). “Maintenance Agreement” means a separate agreement between you and Supplier for maintenance and support purposes. “Origination Fee” means a one-time fee per Schedule of $125 billed on your first invoice which you agree to pay, covering the origination, documentation, processing and other initial costs. “Party” means you or XFS, and “Parties” means both you and XFS. “Term” means the Interim Period, if any, together with the Initial Term for each Schedule plus any subsequent renewal or extension terms. “UCC” means the Uniform Commercial Code of the State(s) where XFS must file UCC-1 financing statements to perfect its interest in the Equipment.
Excess Charges means (a) any Retained POP Charges or Uncovered LATA Charges with respect to the affected Retained POP or Retained Uncovered LATA (as the case may be) or (b) any Retained Number Charges as set forth on the applicable tabs of the spreadsheet attached as Exhibit B, that would, in each case, not have been incurred but for a Continued Migration Failure. Without limiting the foregoing remedy, Level 3 may, at its option, perform any Migration Services which ICG fails to perform and ICG shall cooperate, and shall cause its employees and agents to cooperate, with Level 3 in such performance of the Migration Services.
Excess Charges means any charges SoloProtect is entitled to levy due to the Customer exceeding any usage limits, such limits as communicated in the Agreement or any Additional Services Schedule.
Excess Charges means any usage charges of the Cloud Services beyond the Committed Expenditure during the Commitment Period. Order Form means an ordering document or form, for the provision of Cloud Services, Customer Success Services and/or Consulting Services. Redis Content means any content made available to Customer through the Cloud Services, including but not limited to documentation, training guides, and videos. Services means Support Services, Customer Success Services and Consulting Services. Service Level Agreement or SLA means the current Cloud Services Service Level Agreement which applies to the Cloud Services, available at xxxxx://xxxxx.xxx/legal/redis-enterprise-cloud-service-level-agreement/. Shard means a Cloud Services process that can support a certain dataset size (in GBs) at a certain throughput (in operations/second). Shards are used to size Customer’s workload. Software means the software required for providing the Cloud Services. Subscription Term means the term or period specified in a Transaction and includes the Initial Term and any Renewal Term. Support Services has the meaning set forth in Section 2.9 (Support Services) and does not include Customer Success Services. Transaction means the offer and acceptance by Customer of Cloud Services, Customer Success Services and/or Consulting Services to Customer through the (i) execution of an Order Form or SOW, (ii) completing an online order, (iii) a purchase through a third party reseller or (iv) through a Marketplace that includes the applicable pricing and licensing specifics.
Excess Charges means charges in excess of the SmartClick Allowance.
