Excluded Field of Use definition

Excluded Field of Use means (i) the treatment, palliation, prevention or diagnosis of any retinal disease, disorder or condition in humans in the Ultra-Rare Field [***], or (ii) the treatment, diagnosis, prevention and palliation of any and all balance disorders or diseases pertaining to the inner ear and/or any and all hearing diseases or disorders, including hearing disorders of the inner ear. For clarity with respect to (ii), in the case of any disorders or diseases affecting balance, hearing or the inner ear which also affect other sensory perceptions, organs or tissues, the Excluded Field of Use will only include such disorders or diseases to the extent pertaining to balance, hearing or the inner ear.
Excluded Field of Use means the treatment of cerebral palsy in a patient using cells initially derived from such patient in Taiwan.
Excluded Field of Use means any field of use other than the creation of encrypted channels between two or more of the licensee’s own products. Without limiting the generality of the following, “Excluded Field of Use” shall include any field of use relating to the creation of (i) a centralized security clearinghouse of secure domain names; (ii) a system or a service that validates the request for access using a secure domain name and facilitates creation of encrypted communication channels between two devices when, either, one (heterogeneous environment) or none of the devices involved and/or its operating system is manufactured by the licensee; or (iii) a system or a service that acts as a broker for automatic creation of encrypted communication channels, upon secure domain name lookup, between two devices not manufactured by the licensee.

  • Notwithstanding anything herein to the contrary, Sublicensee acknowledges and agrees that Sublicensee has no right or sublicense under the Patents Rights in any Excluded Field of Use.

  • For the avoidance of doubt, neither TDTx, its Affiliates nor any Sublicensee shall use or practice the Licensed Intellectual Property with respect to any Excluded Target or any Excluded Field of Use, unless and until any such rights revert back to either of the Licensors under the applicable Existing Third Party License/Sublicense Agreement, wherein such reversion of rights to Licensors would then be automatically included in the license grant to TDTx as provided in Section 2.1.

  • Licensor hereby grants to License Holder, a perpetual, worldwide license under any and all of the Current Intellectual Property Rights and the Future Intellectual Property Rights directly or indirectly to reproduce, distribute, publicly perform and display, prepare derivative works, exploit, modify, make, have made, use, sell transfer or install any products or services, whether in or outside of the Original Field of Use; provided, however, that such license shall not extend to the Excluded Field of Use.

  • The GDF License to be granted under Section 3.3 of this Agreement does not include uses in any field of use that involve markets, applications or uses (of any kind) contemplated by PGS, HBT or any or their Affiliates, uses or applications involving Hydrogen Generation Technology and other uses not within the Excluded Field of Use.

  • Fargo hereby grants to Primera a world-wide, irrevocable, non-exclusive, royalty-free, perpetual right and license, without the right to sublicense (other than to an Affiliate of Primera, provided that such Affiliate agrees in writing to be bound by all of the provisions of this Agreement), to make, use, sell, and have sold products using the Fargo Technology other than in the Excluded Field of Use.


More Definitions of Excluded Field of Use

Excluded Field of Use as used in this Agreement means 1) nucleic acid amplification methods, including but not limited to PCR, and Ligand-binding Assays, carried out in a sleeve reaction chamber without integral means of detecting reaction substrates or products, and which reaction chamber is coupled to electrophoresis, and 2) all other uses not expressly granted in the Exclusive Field-of-Use. The right to lease Licensed Products is expressly excluded from this Agreement.
Excluded Field of Use means the field related to intraluminal stent technology.
Excluded Field of Use means the development, production, quality control, marketing, sale and distribution of (i) printers principally designed for (a) card production and reproduction (including without limitation cards and similar products used for identification or security purposes), (b) page production and reproduction supporting media up to and including 11" x 17" in size and (c) digital photo production and reproduction and (ii) all media, accessories and products related thereto. 1.11"Governmental Authority" means any federal, state, local, foreign or international court, government, department, commission, board, bureau, agency, official or other regulatory, administrative or governmental authority. 1.12"Person" means an individual, a partnership, an association, a corporation, a trust, a joint venture, an unincorporated organization, a limited liability entity, any other entity and any Governmental Authority.
Excluded Field of Use means the treatment of ophthalmic diseases in the Critical Field of Use or Non-Critical Field of Use (other than through the use of the Topical siRNA) in which a drug is delivered through systemic administration only (and not through, in whole or in part, topical application, ocular injection or any other method).
