Excluded Minutes definition
Excluded Minutes means the period of any outage that is attributed to one or more of the SLA Credit Exclusions (detailed in clause 3.2 and 3.3) during a Measurement Period. “Measurement Period” means the month in which the Claimed Outage occurred. “Verified Outage” means a Claimed Outage for a service that has been verified by us.
Excluded Minutes means when the Cloud Service is not available because of (a) a Force Majeure Event; (b) general Internet connectivity issues; (c) equipment or software made available by anyone other than Provider and that is not within Provider’s reasonable control; or (d) Customer’s use of the Cloud Service in a manner not authorized by the Agreement.
Excluded Minutes means the minutes that the Covered Service is not Available caused by one or more of the following:
A) acts or omissions of Customer, its agents, employees, or contractors, or acts or modifications as directed or authorized by Customer, or breach of the terms of the Agreement that apply to the Covered Service;
B) Customer’s failure to adhere to Adobe’s documented recommendations, including hardware or
C) Spikes in demand for system resources for which Customer and Adobe did previously not agree in writing to a process to allow Adobe to make accommodation for such increase in demand unless otherwise agreed to in a Sales Order; or
D) software, hardware, or third-party services not provided or controlled by Adobe, or events beyond Adobe’s reasonable control, including but not limited to force majeure events, any law, regulation or order issued by the government, or any agency or department, which, in the reasonable opinion of Adobe, effectively prohibits or restricts Adobe from offering the Covered Service, or imposes significant additional costs on Adobe to provide the Covered Service, in the territory.

If Provider can verify Cloud Service unavailability in its internal monitoring systems and the disruption does not qualify as Excluded Minutes or Scheduled Downtime, Provider will calculate and issue the applicable Service Credit on Customer’s account to apply towards a future invoice.
If Provider can verify Cloud Service unavailability in its internal monitoring systems and the disruption does not qualify as Excluded Minutes or Scheduled Downtime, Provider will calculate and issue the applicable Uptime Credit on Customer’s account to apply towards a future invoice.

Excluded Minutes means the minutes that the Covered Services are not Available caused by one or more of the following:
Excluded Minutes means that the total number of minutes the Cloud Services were not available as a consequence of the exclusions set forth below in Section 6.04, as reasonably determined by ▇▇▇▇▇▇.
Excluded Minutes means the period of any outage (measured in minutes) in the Measurement Period due a Service Level Credit Exclusion.
Excluded Minutes means any minutes during the applicable calendar month when a Service is not fully available due to scheduled routine maintenance. CUSTOMER is to be notified of scheduled maintenance for each contract year at least thirty (30) days in advance. In no event may Excluded Minutes exceed five (5) hours per month. For the avoidance of doubt, lack of Service Availability other than during scheduled routine maintenance does not constitute Excluded Minutes.

D) software, hardware, or third-party services or third-party integrations not provided or controlled by Adobe, or events beyond Adobe’s reasonable control, including but not limited to force majeure events, any law, regulation or order issued by the government, or any agency or department, which, in the reasonable opinion of Adobe, effectively prohibits or restricts Adobe from offering the Covered Service, or imposes significant additional costs on Adobe to provide the Covered Service, in the territory.

(4) software, hardware, or third-party services not provided or controlled by Adobe, or events beyond Adobe’s reasonable control.
