MCXCCL shall not be responsible and shall not be held liable or accountable or responsible for value of the goods /stock of the commodities stored/lying in MCXCCL designated warehouse/s, and which is fully/partially confiscated / seized by any local or statutory or any other authority for any reason whatsoever or for any deterioration in quality of the goods stored due to above reason or which have passed the Final Expiry Date and continue to remain in MCXCCL accredited warehouse.
This Guaranty is a continuing guaranty and shall (a) remain in full force and effect until the latest of (i) the payment in full in cash of all Obligations payable under this Agreement and (ii) the Final Expiry Date, (b) be binding upon the Guarantors, their successors and assigns and (c) inure to the benefit of and be enforceable by the Lenders and their successors, transferees and assigns.
It cannot be renewed beyond the Final Expiry Date shown in the Policy Schedule.
In making such a determination, the Independent Expert will have regard to prevailing market rates of return to equity for projects with a similar risk profile to this Project, and apply those to the forecast Project cash flows over the period from the Expiry Date to the Final Expiry Date.
