Force Majeure Causes shall not affect Tenant’s obligation to pay Rent or the length of the Term.
Seller shall not be liable for excess re-procurement costs pursuant to the Cure & Default provisions of this Contract incurred by Buyer because of any failure to perform this Contract under its terms if the failure arises from Force Majeure Causes beyond the control and without the fault or negligence of Seller.
The provisions of Section 35.04 regarding Force Majeure Causes shall have no applicability to the provisions of this Article 20, and in no event will any of the time periods set forth in this Article 20 be extended as the result of Force Majeure Causes.

If either party is delayed in the performance of any covenant of this Lease (excluding Tenant’s obligation to pay Rent) because of any Force Majeure Causes, then that performance of that covenant shall be excused for the period of the delay.
