Fund Party definition

Fund Party means, as applicable, the manager, general partner, trustee orIncorporated Fund acting for the account of a Relevant Fund or Relevant FundSegment, as the case may be. 1.3 References in this Agreement to a Unit Trust “entering into” a Clearing Agreement orTransaction through the Fund Party shall be construed as the Fund Party as trustee of thatUnit Trust entering in that Clearing Agreement or Transaction, as the case may be. Inaddition, references in this Part 4 to a Unit Trust “acting through” the Fund Party shall beconstrued as the Fund Party acting as trustee of that Unit Trust.

  • Any notice or amendment required or permitted hereunder shall be in writing and shall be given by personal service, mail, or facsimile to the other Party at the address set forth below (or such other address as a Fund Party or the Trust Entity may specify by written notice to the other).
