Gas Contracts definition

Gas Contracts means the Gas Supply Contracts and the Gas Transportation Contracts.
Gas Contracts means any agreements or other legally binding obligations (including those based on purchase orders) entered into by either a Company Group Entity or a Seller Group Entity and effective as of the Closing Date for the provision of any gases (including, hydrogen and nitrogen) for the operations of the SSMC Gifu facilities and/or the SSMC Gunma facilities.”
Gas Contracts means the following Contracts to which Duke Energy or any of its Affiliates is a party or by which it or any of its Affiliates or any of their respective Assets is bound, except for any such Contract or part thereof (i) that is expressly contemplated not to be transferred or assigned by any member of the Duke Energy Group to Spectra Energy, or (ii) that is expressly contemplated to be transferred or assigned to (or remain with) any member of the Duke Energy Group, in each case, pursuant to any provision of this Agreement or any Ancillary Agreement: (i) any Contract entered into in the name of, or expressly on behalf of, any division, business unit or member of the Spectra Energy Group; (ii) any Contract that relates primarily to the Gas Business; (iii) any Contract representing capital or operating equipment lease obligations of facilities or equipment primarily used by any member of the Spectra Energy Group; (iv) any Contract or part thereof that is otherwise expressly contemplated pursuant to this Agreement or any of the Ancillary Agreements to be retained by, transferred or assigned to, any member of the Spectra Energy Group; (v) any guarantee, indemnity, representation or warranty of any member of the Spectra Energy Group; and (vi) the Contracts listed or described on Schedule 1.1(68)(vi).

Gas Contracts means all of the Company’s and Subsidiaries’ right, title and interest in and to gas sales contracts, transportation agreements, gas purchase contracts, processing agreements, treating agreements, gathering agreements, compression agreements and pipeline operational balancing agreements listed on Exhibit 14.1.
