Health Examinations. The Superintendent, at the Superintendent's election, shall be provided a medical examination in each contract year at the cost of the Board. To be reimbursed for such medical examination, the Superintendent shall provide the President of the Board of Education with a statement from the physician certifying to the physical competency of the Superintendent to perform the essential functions of the Superintendent's position. Such statement shall be placed in a separate medical personnel file and remain confidential as and to the extent permitted by law. Indemnification: The district shall, to the extent permitted by law, defend, hold harmless and indemnify the Superintendent from any and all demands, claims, suits, actions and legal proceedings brought against the Superintendent in the Superintendent's individual capacity of the Superintendent's official capacity as an agent or employee of the district, provided that the incident arose with the Superintendent was acting (or in good faith, reasonably believed that the Superintendent was acting) within the scope of the Superintendent's employment with the district. This provision shall not apply to criminal proceedings against the Superintendent and shall not obligate the district beyond any applicable insurance coverage the district has available. DUTIES
Health Examinations. When required by the Administration, the employees will submit to a physical examination, stool examination and/or culture, including laboratory tests, x-rays, inoculations and vaccination, it being understood that the expense of such shall be borne by the Hospital and without limiting the generality of the foregoing, the employees agree to submit to any required from time to time by the Public Act, and amendments thereto and/or regulations passed thereunder. Health Examinations. The FSMC shall have all of its employees assigned to duty on the Premises submit to periodic health examinations, if required by law, and shall submit satisfactory evidence of compliance with all health regulations to the SFA’s medical section upon request. The cost of such examinations shall be a Direct Operating Cost.
