Included Product means any pharmaceutical or biological composition containing the Compound, including the product currently trademarked in the United States as AndexXa™. For clarity, references in this Agreement to “an” Included Product or to “the” Included Product refer to any Included Product.

Included Product means, as of the Funding Date, Optune, NovoTAL and the Novo TTF-100L System, and, thereafter, any future product, including any current Preclinical Products (a) commercialized by Borrower or its Subsidiaries which are owned or controlled by Borrower or its Subsidiaries or (b) out-licensed by Borrower or its Subsidiaries.

The Company shall use Commercially Reasonable and Diligent Efforts, itself or through one or more Subsidiaries or Licensees, to Commercialize the Included Product included in the Collateral for which Marketing Authorization is obtained.

Included Product means Tebi and each Back-up Product. For clarity, references in this Agreement to “an” Included Product or to “the” Included Product(s) refer to any Included Product(s).

For clarity, Included Products shall include the product that is the subject of NDA 219713 that was submitted by the Company to the FDA on October 23, 2024, regardless of the trade or brand name of such product (the “Initial Included Product”).
