Indenture Properties definition

Indenture Properties means each “Restricted Property” (as defined in the Indentures) of the Company and each “Restricted Subsidiary” (as defined in the Indentures).
Indenture Properties means, (a) in case of the Company Indentures, (i) each “Restricted Property” (as defined in the applicable Company Indentures) of the Company and each “Restricted Subsidiary” (as defined in the applicable Company Indentures) and (ii) each “Principal Property” (as defined in the applicable Company Indentures) of the Company and each “Manufacturing Subsidiary” (as defined in the applicable Company Indentures) and Capital Stock (as defined in the applicable Company Indentures) of each “Manufacturing Subsidiary” (as defined in the applicable Company Indentures), and (b) in case of the Xxxxxx Indenture, each “Principal Property” (as defined in the Xxxxxx Indenture) owned or leased by Xxxxxx or owned or leased by a “Restricted Subsidiary” (as defined in the Xxxxxx Indenture) and shares of stock or Debt (as defined in the Xxxxxx Indenture) of each “Restricted Subsidiary” (as defined in the Xxxxxx Indenture).
Indenture Properties set forth in Section 1.01 of the Existing Guarantee and Collateral Agreement is hereby amended by amending and restating clause (b) of such definition in its entirety to read as follows:

Examples of Indenture Properties in a sentence

  • Nothing in the preceding two sentences shall result in the aggregate amount of the Obligations secured by the Indenture Properties exceeding the maximum amount of the Obligations that can be so secured without violation of the Indentures.

  • The parties acknowledge, however, that the obligation of Partnership under the Assignment Agreement to reimburse Management Company the costs and expenses incurred by Management Company for management services provided on behalf of the Partnership for the Indenture Properties shall be waived so long as such costs are fully reimbursed by Owner under the terms of the Management Services Agreement (the foregoing provision to not constitute a release of the obligations of Partnership).

Related to Indenture Properties

  • Indenture Estate shall have the meaning specified in the Granting Clause of the Lease Indenture.

  • Operative Indentures means, as of any date, each “Indenture” (as such term is defined in the Note Purchase Agreement), including the Indenture, whether or not any other “Indenture” shall have been entered into before or after the date of the Indenture, but only if as of such date all “Equipment Notes” (as defined in each such “Indenture”) are held by the “Subordination Agent” under the “Intercreditor Agreement”, as such terms are defined in each such “Indenture”.

  • Initial Properties means collectively the Properties listed on Schedule 1.1 and “Initial Property” means any of such Properties.

  • Indenture means this Indenture, as amended or supplemented from time to time.

  • Indenture Collateral has the meaning set forth in the Granting Clause of the Indenture.

  • Mortgaged Properties the real properties listed on Schedule 1.1B, as to which the Administrative Agent for the benefit of the Lenders shall be granted a Lien pursuant to the Mortgages.

  • Common Properties means and refer to those areas of land shown on any recorded subdivision plat of The Properties and intended to be devoted to the common use and enjoyment of the owners of The Properties.

  • Additional Properties means any oil and natural gas assets or related interests that are acquired by any member of the Partnership Group pursuant to an Acquisition.

  • Securitization Property means the property described in section 10j.

  • Real Properties means the real property owned by the Borrower or any of its Subsidiaries.

  • Senior Subordinated Notes Indenture means the Indenture, dated as of July 17, 2012, under which the Senior Subordinated Notes were issued, among the Borrower and the Restricted Subsidiaries party thereto and the trustee named therein from time to time, as in effect on the Closing Date and as amended, restated, supplemented or otherwise modified from time to time in accordance with the requirements thereof and of this Agreement.

  • Subject Properties has the meaning specified in Section 5.13(a).

  • Trust Indenture Estate means all estate, right, title and interest of the Indenture Trustee in and to the properties referred to in the Granting Clause of the Trust Indenture, excluding Excluded Payments.

  • Foreclosure Property shall have the meaning assigned to such term in the Servicing Agreement or such other analogous term used in the Servicing Agreement.

  • Indenture Notes means the Notes.

  • Material Properties means (a) those Mortgaged Properties designated on Schedule 3.12 as Material Properties and (b) each other Mortgaged Property with respect to which a Mortgage is granted pursuant to Section 5.11 after the Restatement Effective Date.

  • First Mortgage Indenture means a first mortgage indenture pursuant to which any Borrower or any Subsidiary of any Borrower may issue bonds, notes or similar instruments secured by a lien on all or substantially all of such Borrower’s or such Subsidiary’s fixed assets, as the case may be.

  • Mortgage Indenture means the Mortgage and Deed of Trust, dated as of April 1, 1932, between SIGECO and Bankers Trust Company (as supplemented from time to time before or after the date hereof by various supplemental indentures thereto).

  • Subordinated Notes Indenture means that certain Subordinated Debenture Indenture between DH (f/k/a NGC Corporation) and First National Bank of Chicago, as Debenture Trustee, dated as of May 28, 1997 (as amended, restated and supplemented through the Petition Date).

  • immovable property shall have the meaning which it has under the law of the Contracting State in which the property in question is situated. The term shall in any case include property accessory to immovable property, livestock and equipment used in agriculture and forestry, rights to which the provisions of general law respecting landed property apply, usufruct of immovable property and rights to variable or fixed payments as consideration for the working of, or the right to work, mineral deposits, sources and other natural resources; ships, boats and aircraft shall not be regarded as immovable property.

  • Senior Subordinated Note Indenture means the Indenture dated as of May 12, 2009, between the Company and U.S. Bank National Association, as trustee, in respect of the 2020 Senior Subordinated Notes and the 2023 Senior Subordinated Notes, as supplemented and amended from time to time.

  • Real Property Security Documents means the Landlord Consent and any mortgage or deed of trust or any other real property security document executed or required hereunder to be executed by any Obligor and granting a security interest in real Property owned or leased (as tenant) by any Obligor in favor of the Lenders.
