Individual with the most significant disability means an individual with a disability:
Individual with the most significant disability means an individual with a significant disability who meets the designated State unit's criteria for an individual with a most significant disability. These criteria must be consistent with the requirements in 34 CFR 361.36(d)(1) and (2):
Individual with the most significant disability means an individual with a significant disability whose impairment seriously limits two or more functional capacities in terms of an employment outcome.

  • Permanent Disability means the Employee’s inability to perform the essential functions of the Employee’s position, with or without reasonable accommodation, for a period of at least 120 consecutive days because of a physical or mental impairment.
