Merchant acknowledges and agrees that in order to comply with regulatory and Payment Card Network Rule requirements, Processor will need to have a direct contractual relationship with Merchant in order to be able to make the Processing Services available to Merchant and will need to perform Know Your Customer (KYC) and Anti-Money Laundering and Anti-Terrorist Financing (AML) verifications with respect to Merchant in accordance with applicable laws and Scheme Rules.
This Agreement is subject to the provision by Customer of the Know Your Customer (“KYC”) and Financial Intelligence Centre Act (“FICA”) information set forth in Clause 23 (Information undertakings – All Customers) of the Agreement.
Once the Agreement has duly entered into force, TSO may assess at any time the compliance of the Network User with the "Know Your Customer" requirements and may request the Network User to demonstrate its compliance with the Creditworthiness provisions and “Know Your Customer” requirements.
A Primary Purchaser will not receive its Song Token unless and until such Primary Purchaser successfully completes (as determined by NFTonKEY in its sole discretion) any applicable diligence, including without limitation any Know Your Customer, anti-money laundering, sanctions, and other processes as requested by NFTonKEY.
