Latent Condition definition

Latent Condition means physical conditions of the Asset which differ materially from the physical conditions which should reasonably have been anticipated by the Contractor at the time if the Contractor had:
Latent Condition means any physical condition on the Site, excluding weather condition, which differs substantially from the physical condition which could reasonably be expected by the Contractor at the time of entering into the Contract, if the Contractor had conducted all reasonable inspections of the Site and obtained any necessary reports, including foundations data.
Latent Condition means any physical condition on or below the site, or the area surrounding the site, which differs materially from the physical conditions which could reasonably have been expected by the Contractor at the time the Contract was entered into.

Examples of Latent Condition in a sentence

  • If the estimated additional cost to remedy any geotechnical condition that qualifies as a Latent Condition is reasonably estimated to increase the Estimated Project Budget by more than $150,000, then upon written request of MSR, the City will work with SPS and MSR to identify additional funding to address the condition, which may include, but not be limited to, private sources.

  • However, if the discovered Hazardous Substances qualify in part or in whole as a Known Condition or Latent Condition, then the City, SPS, and MSR shall use good faith efforts to mutually agree upon a funding plan, which may include use of Project contingency funds or additional funding from SPS or the City.

  • MSR shall promptly notify the City Representative and SPS Representative if, during the course of demolition and construction, MSR or any of its agents or contractors discover any geotechnical condition on or around the Licensed Area that qualifies as a Latent Condition and that is likely to result in a change order to MSR’s contract with the Prime Contractor.

  • If any Latent Condition, asbestos or hazardous material is located at the Site, it is the Customer’s sole responsibility (including costs) to ensure the safe and prompt removal of it.

Latent Condition means physical conditions on or in the Site, including artificial things but excluding weather conditions, or the effects of weather conditions, which differ materially from the physical conditions which should reasonably have been anticipated by the Contractor at the time if the Contractor had:
Latent Condition means any physical condition on or below or within the site, or the area surrounding the site, which differs materially from the physical conditions which could reasonably have been expected by us at the time our quotation was provided.
Latent Condition means any physical condition or characteristic of the Site and its surrounds, including below ground conditions, all natural and artificial things, asbestos, contamination and other environmentally hazardous substances, concrete cracking and spalling, facilities, utilities and services on or below surface and, if the whole of the Subcontract Works involve work to an existing building, those things obscured behind walls, ceilings and the floors, which differ from the conditions and characteristics which should reasonably have been anticipated by a competent subcontractor at the time of the Subcontractor’s tender. ‘month’ means calendar month. ‘Practical Completionin respect of the Subcontract Works has the meaning under the Head Contract in respect of the Project so far as it is applicable to the Subcontract Works.
Latent Condition means an aspect of the Services or the Project, including physical conditions on the Project site or its surroundings, which differs materially from what could reasonably have been anticipated by us at the time we prepared the Proposal, including conditions that were known by you and not disclosed to us.
