Latent Condition definition

Latent Condition means physical conditions of the Asset which differ materially from the physical conditions which should reasonably have been anticipated by the Contractor at the time if the Contractor had:
Latent Condition means any physical condition on the Site, excluding weather condition, which differs substantially from the physical condition which could reasonably be expected by the Contractor at the time of entering into the Contract, if the Contractor had conducted all reasonable inspections of the Site and obtained any necessary reports, including foundations data.
Latent Condition means any physical condition on or below the site, or the area surrounding the site, which differs materially from the physical conditions which could reasonably have been expected by the Contractor at the time the Contract was entered into.

  • The Contract Administrator must, within 14 days of receipt of the Contractor's notice under paragraph (a): notify the Contractor and the Commonwealth of its determination whether a Latent Condition has been encountered or found; and instruct the Contractor as to the course it must adopt insofar as the Contractor's Activities are affected by the Latent Condition.

  • If the Contractor considers it has encountered or found a Latent Condition, it must immediately give the Contract Administrator and the Commonwealth notice in writing.

Latent Condition means physical conditions on or in the Site, including artificial things but excluding weather conditions, or the effects of weather conditions, which differ materially from the physical conditions which should reasonably have been anticipated by the Contractor at the time if the Contractor had:
Latent Condition means physical conditions on site or affecting the site which differ materially from the physical conditions which should have reasonably been anticipated at the time of contracting.
Latent Condition has the meaning given to that term under clause 13.2.
Latent Condition means any physical condition or characteristic of the Site and its surrounds, including below ground conditions, all natural and artificial things, asbestos, contamination and other environmentally hazardous substances, concrete cracking and spalling, facilities, utilities and services on or below surface and, if the whole of the Subcontract Works involve work to an existing building, those things obscured behind walls, ceilings and the floors, which differ from the conditions and characteristics which should reasonably have been anticipated by a competent subcontractor at the time of the Subcontractor’s tender. ‘month’ means calendar month. ‘Practical Completionin respect of the Subcontract Works has the meaning under the Head Contract in respect of the Project so far as it is applicable to the Subcontract Works.
