If the parties fail to agree terms of settlement within 90 days of the initiation of the procedure the dispute may be referred to an arbitrator as agreed between the parties or failing such agreement as may be nominated by the President of the Law Society of England and Wales upon application of any Party.
If the Insured does not agree with a decision by the Underwriters to settle a Claim covered under this Policy, the Insured can elect to contest the Claim at its own expense, but the liability of the Underwriters will not exceed the amount for which the Claim covered under this Policy could have been settled in the opinion of a senior legal counsel (to be mutually agreed upon by the Insured and the Underwriters or in the absence of agreement by determination of the President of the New Zealand Law Society).
