Lead Plaintiff’s Released Claims shall not include: (i) any claims asserted by shareholders on behalf of Align in the two related derivative lawsuits that have been stayed pending the resolution of this Action (In re Align Tech., Inc. Deriv. Litig., Case No. 19-CV-00202-LHK (N.D. Cal.) and Muhammad Abbas v. Joseph M. Hogan, et. al., Case No. 19CV346429 (Sup. Ct. Cnty. of Santa Clara)); (ii) any claims relating to the enforcement of the Settlement; or (iii) any claims of any person or entity who or which submits a request for exclusion from the Settlement Class that is accepted by the Court.
