Within ten (10) days of Closing (if the same has not already occurred prior to closing), Redeveloper’s designated Licensed Site Remediation Professional (the “LSRP”) shall notify the NJDEP via its web-portal that she/he will be serving as LSRP for the Property and file the Site Contact and Information Update Form with the NJDEP.
The Trustee shall make payment from the Fund as the Department or retained Licensed Site Remediation Professional (LSRP) identified on Schedule “D” shall direct, in writing, to provide for the payment of the costs of remediation of the Site(s) submitted in accordance with N.J.A.C. 7:26C-5.12.
No environmental due diligence may be done by a Licensed Site Remediation Professional (LSRP).
In conducting the Due Diligence, Redeveloper shall NOT utilize the services of a Licensed Site Remediation Professional (LSRP) or Licensed Subsurface Evaluator (as such terms are defined under Environmental Laws).
This schedule shall be updated anytime there is a change in the retained Licensed Site Remediation Professional and a copy submitted to the Department.
