Examples of Materials and Equipment in a sentence
The Contractor assumes the risk of loss or damage, whether direct or indirect and of whatever nature, to the Work or to any Materials and Equipment furnished, used, installed or received by the Owner, the Owner’s Representative, materialmen or workmen in preparation for and in performing the Work.
All Subcontracts shall be in a form similar to this Contract with respect to the separation of the sale of Materials and Equipment from the work, labor, services, consumable supplies and any other items to be provided.
The Contractor shall make deliveries of all such Materials and Equipment to the Project Site at such times (including overtime days or hours if necessary) so as to avoid delays to the Work or the Project.
All Materials and Equipment furnished or installed by the Contractor shall be free of all claims, liens and encumbrances including, without limitation, conditional bills of sale, security agreements, financing statements or chattel mortgages.
This exemption does not apply to tools, machinery, equipment or other property leased by the Contractor or its Subcontractors, or to Materials and Equipment or other property that are consumed in the course of construction or for any other reason not incorporated into the real property which is improved under this Contract.
