Merchant Application has the meaning set forth on the Merchant Application.
Merchant Application means the Servicer application form completed by the Merchant, and which references these Terms and Conditions.
Merchant Application means the application which Merchant signed and submitted to Pivotal in order to be eligible to receive the payment processing services described in this TOS. (This definition of Merchant Application is consistent with that ascribed to it in the Merchant Application itself.)

Merchant further acknowledges that its Merchant Application may be rejected by Processor or Bank and that neither Processor nor Bank shall have any liability associated with such rejection.
Notices to the Bank or the Processor must be sent to the addresses respectively designated on the Merchant Application for those entities, and will be deemed effective upon receipt.
