Subject to the execution of a Non-Disclosure Agreement, a bargaining unit employee who is an Author is entitled to receive upon request supporting documentation (including but not limited to relevant terms of the Agreement or the Agreement itself, subject to a Non-Disclosure Agreement and redaction of non-relevant information) necessary to evidence the calculation of the Initial Option Payment, Gross Compensation, Net Compensation, and the Author’s Share, and payment for the Author’s services.
The Company will create a pool equal to 10% of Net Compensation that will be distributed equally to such contributors, should they exist.
After the pool has been distributed, the Company and the Author will divide the remaining Net Compensation as set forth in Section E(i) above.
It is understood that the existence of an Agreement for a Work of which a bargaining unit employee is an Author does not necessarily mean that there will be an Initial Option Payment, Option Renewal Payment, or Net Compensation on which to base the Author’s Share and that, in any case, neither an Initial Option Payment, Option Renewal Payment, nor any Author’s Share payments is guaranteed; such payment(s) may not exist at all.
The Company will pay the Author’s Share within 45 days of the Company’s receipt (if and as applicable) of any Initial Option Payment, Option Renewal Payment, or Net Compensation to which the Author’s Share relates.
