Examples of New Indication in a sentence
If ARIAD US applies for a Marketing Authorization (or equivalent) of the Product in the U.S. for a New Indication, ARIAD US will disclose full details at the JSC and may request that ARIAD SWISSCO seek Registration of the Product for the New Indication in the Territory using the Development Data provided by ARIAD US (if not already available to ARIAD SWISSCO under the terms of this Agreement.
ARIAD SWISSCO will consider such request in good faith, including analyzing the commercial viability of Commercializing the Product with the New Indication in the Territory.
The Other Party may reverse its election not to pursue such development, by Notice to the Proposing Party, at any time prior to the registration of such New Indication or Line Extension in the first country in Territory B in which registration is made, subject to the reimbursement of [*] of all [*] incurred by the Proposing Party with respect to such New Indication or Line Extension as of the date on which such Notice is made.
The final decision regarding whether to seek registration for such New Indication in the Territory, or at least some countries of the Territory, shall be in [**] sole discretion.
Notwithstanding the foregoing, the limitations set forth in this Section 2.5.1 shall not apply to any New Indication, subject to Section 2.6.
