New Indication definition

New Indication means any indication other than the Initial Indication.
New Indication means any indication in the Field, being any disease, condition or syndrome other than CML or Philadelphia chromosome positive ALL. For clarity, new lines of therapy within an already approved indication or for another subset of patients within an already approved indication (e.g., pediatric Ph+ ALL) would not qualify as a New Indication.
New Indication means an indication for the treatment of any disease or condition other than the Existing Indications.

Examples of New Indication in a sentence

  • If ARIAD US applies for a Marketing Authorization (or equivalent) of the Product in the U.S. for a New Indication, ARIAD US will disclose full details at the JSC and may request that ARIAD SWISSCO seek Registration of the Product for the New Indication in the Territory using the Development Data provided by ARIAD US (if not already available to ARIAD SWISSCO under the terms of this Agreement.

  • ARIAD SWISSCO will consider such request in good faith, including analyzing the commercial viability of Commercializing the Product with the New Indication in the Territory.

  • Notwithstanding anything in this Agreement to the contrary, the provisions of this Section 5.7 shall not apply to regulatory submissions or Regulatory Approvals for New Licensed Product or New Indication Existing Licensed Product that a Party Develops pursuant to, and in accordance with, Section 5.11 or Section 5.12, which such regulatory submissions and Regulatory Approvals shall be the sole responsibility of and solely owned by such Party.

  • Notwithstanding the foregoing, the limitations set forth in this Section 2.5.1 shall not apply to any New Indication, subject to Section 2.6.

  • Any Combination Product or Mono Product to achieve the Development Milestone Events in a New Indication after the first achievement of the Development Milestone Events as described in the foregoing sentence will cause the amounts in Column (b) with respect to a Combination Product and Column (d) with respect to a Mono Product to be due and payable by Coya upon each such occurrence.


More Definitions of New Indication

New Indication means the development and commercialization of Products in any other indication but the Launch Indication.
New Indication means, with respect to development conducted on or after the date hereof, any new therapeutic use or application of any Product.
New Indication means, for each Product and with respect to development conducted on or after January 1, 1997, any new therapeutic use or application of such Product.
