New Patents definition

New Patents means Patents filed after the Effective Date with respect to New Know-How.
New Patents means as defined in Section 9.6 below.
New Patents means any Patents filed by or on behalf of or with the authority of UCLB (for itself or on behalf of UCL), in respect of which the priority filing is first filed after the Effective Date, and which Orchard has elected to include in its licence hereunder pursuant to Clause 8.1.2;

Examples of New Patents in a sentence

  • Lxxxx shall assign and hereby assigns all of its and its Affiliates’ right, title, and interest in any Telix New Know-How and Telix New Patents to Telix, free and clear of all liens, claims, and encumbrances (except for those set forth in this Agreement).

  • Telix shall, subject to the terms of this Agreement, own all Telix New Know-How and Telix New Patents.

  • Lxxxx shall, subject to the terms of this Agreement, own all Lilly New Know-How and Lxxxx New Patents.

  • Telix shall have the right to determine the Telix Patents (other than Joint New Patents) for which it will apply for patent extension in any country, at its cost and expense.

  • Upon Lxxxx’x exercise of its Option, Lxxxx, at Lxxxx’x expense, has, subject to Section 11.2(b)(iii), the sole right and obligation to control the Prosecution and maintenance of the Telix Patents and Telix Radiodiagnostic Patents, other than Joint New Patents, that Cover any Companion Diagnostic, but do not Cover any other product that is not a Companion Diagnostic (“Companion Diagnostic-Specific Telix Patents”), using patent counsel of Lxxxx’x choice.


More Definitions of New Patents

New Patents means any patent(s) issuing from patent applications filed after the Effective date of this License Agreement for any of the record of invention disclosures and/or provisional applications enumerated in the definition ofLicensed Technology” or any Improvements developed by or for Licensor whether wholly or partially owned by Licensor or co-owned with Licensee. The Parties shall fully cooperate with each other with regard to such application and prosecution of the New Patents. The term “Co-owned Patent” means a patent(s) owned by and/or assigned to either or both of the University of South Florida and the Licensor and Licensee (or a successor in interest of any of them) based on the laws of inventorship and ownership.
