Non-Indemnifiable Loss definition

Non-Indemnifiable Loss means LOSS for which the COMPANY or, with respect to INSUREDS described in Clause 2(k)(3) above, the OUTSIDE ENTITY, refuses to indemnify or advance DEFENSE COSTS or other LOSS as required or permitted, or is financially unable to indemnify, or fails to indemnify within 60 days after the INSUREDS request such indemnification; and the INSUREDS comply with Clause 19 (Subrogation) below.
Non-Indemnifiable Loss means Loss which the Insured Entity fails or refuses to indemnify an Insured Person:
Non-Indemnifiable Loss means Loss incurred by an Insured Person for which the Entity is not permitted by common or statutory law to indemnify or is not financially able to indemnify by reason of Financial Impairment.

Examples of Non-Indemnifiable Loss in a sentence

  • Notwithstanding anything to the contrary in this Policy and solely to the extent there is a Non-Indemnifiable Loss, the Insurer shall not seek to rescind the Policy with respect to any Insured Person for any reason.

  • Solely with respect to any Non-Indemnifiable Loss of any Insured Person, under no circumstances shall the coverage provided by this Policy be deemed void, whether by rescission or otherwise, but such coverage will be subject to all other terms, conditions and exclusions of the Policy It is understood and agreed that this provision supersedes any inconsistent language contained in the Application.

  • The Deductible Amount for Non-Indemnifiable Loss set forth in Item 4(a) of the Schedule for this policy shall apply to Loss incurred by any Insured Person for which no Educational Institution is permitted or required to indemnify, or is permitted or required to indemnify but does not do so by reason of Financial Impairment.

  • Any such delayed payment of Loss shall be available to the Insurer to pay Non-Indemnifiable Loss covered under this Policy.

  • No Retention shall apply to Non-Indemnifiable Loss or to Workplace Violence Expenses.
