If Non-Public Personal Information (as that term is defined in the Securities Exchange Commission’s Regulation S-P) regarding either party’s customers or consumers is disclosed to the other party in connection with this agreement, the party receiving such information will not disclose or use that information other than as necessary to carry out the purposes of this agreement.
Each Party will, with respect to such information, comply with Reg S-P and will not disclose any Non-Public Personal Information received in connection with this agreement to any other party, except to the extent required to carry out the services set forth in this agreement or as otherwise permitted by law.
The Parties shall comply with Applicable Law related to privacy and data protection applicable to the mortgage loans, including without limitation, protecting the Borrower’ personal information and financial information in connection with any Loan or Package (including the names, addresses, social security numbers of the Borrower and any Non-Public Personal Information (“NPPI”)) under Applicable Law, including GLBA and similar state laws implementing regulations.
The Parties agree that any Non-Public Personal Information, as the term is defined in Regulation S-P (“Reg S-P”) of the Securities and Exchange Commission, that may be disclosed hereunder is disclosed for the specific purpose of permitting the other Party to perform the services set forth in this agreement.
Except for Non-Public Personal Information, all obligations hereunder regarding the use and disclosure of Confidential Information shall continue for a period of five (5) years from the Effective Date.
