Nonconforming Product definition

Nonconforming Product has the meaning provided for in Section 4.3.
Nonconforming Product means Petroleum Product that Buyer is aware is or could be contaminated, adulterated or fails to meet either the Specifications or the requirements of any governing authority or agency.
Nonconforming Product means any Product that does not meet the Product Specifications or all the applicable Quality Requirements.

Examples of Nonconforming Product in a sentence

  • Return of Defective or Non-conforming Product (without replacement).

  • Without prejudice to Gavilon’s right to reject Nonconforming Product as set forth in Section 3 and without affecting Producer’s liability for the Delivery of Nonconforming Product, Producer shall have no responsibility or liability with respect to Product after its Delivery.

  • Such costs may include, without limitation, reasonably incurred storage costs or costs reasonably incurred by Gavilon to return such Nonconforming Product to Producer.

  • Producer will be responsible for all direct costs of replacing or disposing of any Nonconforming Product, including any costs reasonably incurred by Gavilon as a result of the Nonconforming Product and/or any unreasonable delay by Producer in obtaining conforming Product.

  • Upon verification of such nonconformance, Producer will then direct Gavilon to either (i) sell the Nonconforming Product at a discounted price, or (ii) return the Nonconforming Product to Producer.


More Definitions of Nonconforming Product

Nonconforming Product shall refer to a Product that does not conform to the Product warranty provided in Section 12.3 below.
Nonconforming Product means any products received by Topcon or its Affiliates from Iridex under an Order that (a) is not a Product; (b) does not conform to the make or model number listed in the applicable Order; or (c) on visual inspection, Topcon or its Affiliates reasonably determines are otherwise Defective.

Where the context requires, Nonconforming Products are deemed to be Products for purposes of this Agreement.

Nonconforming Product means any product delivered (or attempted to be delivered) by Seller hereunder which does not meet the specifications set forth in Exhibit 6.1.
