Not Sustained definition
Not Sustained means there is not enough evidence to clearly prove or disprove the alleged misconduct, as set forth in a complaint or brought to the attention of the Commission through other means;
Not Sustained means the investigation produced insufficient information to clearly prove or disprove the allegations;
Not Sustained means there is not enough evidence to clearly prove or disprove the alleged misconduct, or any possible misconduct brought to the attention of the Commission through other means including, evaluation, review, and/or investigation, even if not alleged in the complaint; ( c) Unfounded means the alleged misconduct did not occur or the allegation is not true, based on the preponderance of the evidence presented, which is defined as more likely than not; and, (d) Community Value Violation means conduct, a policy, practice or action that does not meet community expectations regarding health, safety, transparency, accountability, or police effectiveness, even if such conduct does not violate the law or a particular policy of the Police department.
