NOTICES AND DOMICILIUM. 18.1 The Purchaser and the Seller hereby choose their respective addresses (domicilium citandi et executandi) for all purposes in respect of this Deed of Sale, including all notices and Court process to be delivered in terms hereof, the address recorded below his signature hereunder. Any notice sent by pre-paid registered post shall be deemed to have been received on the fifth day after posting; any notice delivered by hand shall be deemed to have been received on the day of delivery; any notice sent by telefax or electronically transmitted by email, shall be deemed to have been received on the first business day after date of despatch thereof. 18.2 Notwithstanding anything to the contrary herein contained, any written notice or communication actually received by a Party to this Agreement shall be deemed to be adequate written notice or communication to him notwithstanding that it was not sent or delivered at the chosen address / domicilium citandi et executandi or transmitted to such Party's telefax number and/or email address as stipulated herein. 18.3 The term "writing" shall include communications by electronic mail or facsimile.

NOTICES AND DOMICILIUM. All documents in legal proceedings and notices in connection with this Agreement shall be served in accordance with clause 33 (Notices) of the Common Terms Agreement, which clause is incorporated by reference in this Agreement as if repeated in this Agreement in full (except that references in that clause to the Common Terms Agreement are to be construed as references to this Agreement).
NOTICES AND DOMICILIUM. 27.1 Each of the parties chooses as his domicilium citandi et executandi (“domicilium”) for the purposes of giving of any notice or the serving of any process and for any other purpose arising from this Agreement their respective addresses as stated above. 27.2 Each of the parties will be entitled from time to time, by written notice to the other party to change his domicilium to any other address within the Republic of South Africa which is not a post office box or poste restante. The changed address will be affective after 14 (fourteen) days of such change. 27.3 Any notice in terms hereof may be delivered to the other party (“the recipient”) by hand, prepaid registered post or E-mail. 27.4 Any notice given by a party to the other which: 27.4.1 is delivered by hand, to a responsible person, during ordinary business hours, at the physical address provided will be presumed to have been received (unless the contrary is proved by the addressee) on the day and time of delivery. 27.4.2 is sent by prepaid registered post, in a correctly addressed envelope, to the postal address specified above will presumed to have been received by the recipient on the seventh day after the date of posting; or 27.4.3 is sent by email to the E-mail address specified will be deemed (unless the contrary is proved by the addressee), to have been received on the first business day after transmission. 27.5 Where in terms of this Agreement any communications are required to be in writing the term writing will include communications by E-mail.
NOTICES AND DOMICILIUM. 12.1 The parties select as their respective domicilia citandi et executandi the physical addresses, and for the purposes of giving or sending any notice provided for or required hereunder, the physical addresses, postal addresses and fax numbers detailed in Service Details or such other address or telefax number as may be substituted by notice given as herein required. 12.2 Any notice addressed to a party at its physical or postal address shall be sent by prepaid registered post, or delivered by hand, or sent by telefax.

Each party shall have the right from time to time to substitute its said domicilium with another address in the Republic of South Africa by giving notice of the appointment of a new address to the other party which notice will be in writing.

NOTICES AND DOMICILIUM. 14.1 The parties choose as their respective domicilium citandi et executandi for the purpose of legal proceedings and for the purposes of giving or sending any notice provided for or necessary in terms of this agreement, their respective addresses set out in the schedule, provided that a party may from time to time change any address to any other physical address, postal address or telefax address within the Republic of South Africa by written notice to the other party to that effect. Such change of address will be effective 7 (Seven) days after receipt of notice of the change of domicilium. 14.2 All notices to be given in terms of this agreement will be in writing and - 14.2.1 if delivered by hand during normal business hours, be rebuttably presumed to have been received on the date of delivery; 14.2.2 if sent by prepaid registered post from within the Republic of South Africa be rebuttably presumed to have been received within 7 (Seven) business days of posting; 14.2.3 if sent by telefax before 16h30 on a business day be rebuttably presumed to have been received on the date of successful transmission of the telefax. Any telefax sent after 16h30 or on a day which is not a business day will rebuttably be presumed to have been received on the following business day. 14.3 Notwithstanding the above, any notice actually received by the party to whom the notice is addressed will be deemed to have been properly given and received, notwithstanding that such notice has not been given in accordance with the provisions of this clause.

NOTICES AND DOMICILIUM. (a) For all purposes of this agreement, the parties do hereby choose their domicilia citandi et executandi as follows: (i) MTC at MTC Head Office, Corner of Xxxx Tjitendero & Hamutenya Wanehepo Ndadi Street, Olympia Windhoek, Namibia; (ii) The Subscriber at the Address selected in section 1 “Subscription Details” in the Application for Services Agreement, as the case may be. (b) Notices may be given either by delivery at the domiciilium citandi et executandi selected in terms of clause 24 (a), of this, or shall be given by prepaid letter addressed to: (i) MTC at P O Xxx 00000 Xxxxxxxx, Xxxxxxx (xx) The Subscriber at the Address selected in section 1 “Subscription Details” in the Application for Services Agreement provided that any notice given by the Subscriber to MTC by letter shall be given by prepaid registered letter. (c) Any notice given by either party to the other shall: (i) If delivered to the domicilium citandi et executandi of such person, be deemed to have been received upon such delivery (ii) If posted by letter, be deemed, unless the contrary be proved, to have been received 7(seven) working days after delivery of such letter to the Post Office for posting.
