Open Market Units: has the meaning afforded to it at Schedule Two.
Unless otherwise agreed with the Council in writing, prior to Occupation of more than 50% of the Open Market Units to deliver and make available in a Serviced Condition the Self-Build and Custom Housebuilding Plots in accordance with the Self-Build and Custom Housebuilding Scheme.
Prior to occupation of 40% (forty percent) of the Open Market Units all of the Affordable Housing Units within the Development must have been constructed in accordance with the Affordable Housing Scheme and be available to be occupied for their intended purpose.
If at the expiration of the Marketing Period any Self-Build and Custom-Build Plots have not been Sold the Owner shall be free to develop them as Open Market Units.
