The Company will continue to be able to complete the work within the line items pertaining to the Contract: (i) in a timely manner so as to permit the date on which the Bossier City Project becomes Operating to occur on or prior to its Operating Deadline; and (ii) within the aggregate amounts specified for the line item on its Construction Disbursement Budget.
The Investment Grade Securities in which the Proceeds are invested shall have maturity dates which reasonably approximate the time when such funds will be required for disbursement under this Agreement, and in no event shall have a maturity date later than six (6) months after the Operating Deadline.

Any time that the amount of Available Funds is less than the amount required in the Construction Disbursement Budget to cause the Project to become Operating on or before the Operating Deadline, and such deficiency continues for a period of thirty (30) days after notice to the Company of such deficiency.
