Operating Member definition

Operating Member means, in relation to a consortium Bidder, the member of such consortium who fulfills the criteria set forth in Clause 1.2.2 of Section II-A.
Operating Member is defined in Section 2.03(a).
Operating Member. – means the Bidder itself if it is a single firm, or a member of the Bidder consortium designated by the Bidder and pre-qualified by Bangladesh Power Development Board (BPDB) as a member having experience in the operation and maintenance of Wind System.

  • Except as otherwise expressly provided in this Agreement, the Members (other than Managing Member acting in its capacity as manager of the Company in accordance with and subject to the terms of this Agreement or Operating Member acting in accordance with the authority delegated by Managing Member to Operating Member subject to the terms of this Agreement) shall have no right, power or authority to act for or on behalf of, or otherwise bind, the Company.
