Other Real Property definition

Other Real Property has the meaning set forth in Section 3.13(a).
Other Real Property means Real Property that is neither Hotel Real Property nor Office Real Property nor Retail Real Property.
Other Real Property means real property that is not tangible property described in subsection (c)(4), is not other residential property, and is not agricultural land.

More Definitions of Other Real Property

Other Real Property as defined in subsection 5.13.
Other Real Property means the real property listed on Schedule 1.1(i) of SellersDisclosure Schedules.

Other Real Property. No APT Entity or, to the Seller’s Knowledge, Minority-Interest Entity, is in default in any material respect under any Real Property Preemptive Rights Agreement and, to the Seller’s Knowledge, no counterparty is in default in any material respect under any Real Property Preemptive Rights Agreements. Each Real Property Preemptive Rights Agreement is a good and valid agreement, enforceable according to its terms against the applicable APT Entity or, to the Seller’s Knowledge, Minority-Interest Entity, and, to the Seller’s Knowledge, against the counterparty thereunder, except to the extent that such enforceability may be limited by (i) applicable bankruptcy, insolvency, reorganization, moratorium, and similar laws affecting creditors’ rights generally, and (ii) equitable principles, which may limit the availability of certain equitable remedies in certain instances.
