Participating Settlement Class Members definition

Participating Settlement Class Members means any Settlement Class Member who is bound by the Final Judgment and receives a distribution as set forth in this Settlement Agreement. All Settlement Class Members are automatically deemed Participating Settlement Class Members unless the Settlement Class Member submits a timely request for exclusion as detailed in the Settlement Class Notice.

Participating Settlement Class Members means all Settlement Class Members who do not file a valid and timely request to opt-out of the Lawsuit and who submit a timely claims form as set forth in paragraph IV.D., below. 15
