In any case, the Company shall be obligated to pay an additional amount that shall be equal to the penalties and interest that would be assessed against the Company if such PILOT Payments were delinquent ad valorem taxes.
If at the end of the period specified in the written notice from the Authority to the Company the Company has failed to make the required PILOT Payments, the Authority shall have the right to terminate the Lease.
If for any reason the Company shall fail to make any such PILOT Payments, the Board of Assessors shall provide the Company with written notice of such failure which shall specify the amount of the PILOT Payments due and payable.
The Company shall pay all School PILOT Payments and all Existing Plant PILOT Payments (collectively, the “PILOT Payments”) described herein at the times and in the manner required for the payment of ordinary ad valorem property taxes.
If for any reason the failure to pay such PILOT Payments has continued for ninety (90) days after receipt of such written notice by the Company, the Authority shall have the right to notify the Company in writing of its intent to terminate the Lease if such failure to pay the PILOT Payments continues for an additional period specified therein which shall not be less than thirty (30) days following receipt of such notice by the Company.
