Prior Note definition

Prior Note shall have the meaning assigned to that term in Section 35 of this Note.

Prior Note has the meaning specified in the Background section hereof.

Prior Note has the meaning given to it in Section 1.1(a).

Examples of Prior Note in a sentence

• Each Holder agrees that this Amendment shall be affixed by each Holder to its Prior Note and become a part thereof.

• This Amendment is not intended to serve as, and shall not be construed by operation of law or otherwise, as a novation of the Prior Note.

• As used herein, terms that are defined herein shall have the meanings as so defined, and terms not so defined shall have the meanings as set forth in the Prior Note.

Prior Note has the meaning set forth in Section 1 of this Note.

Prior Note means the Company’s Senior Secured Convertible Promissory Note due January 1, 2019, issued by the Company to each Purchaser hereunder on July 2, 2018.

Prior Note means the “Colorado High Performance Transportation Enterprise Toll Revenue Note (I-70 West Peak Period Shoulder Lanes Project), Series 2014 issued to and held by the Prior Lender, which evidences the Borrower’s obligation to pay the principal of and interest on the Prior Loan.

Prior Note and “2008 Note” each has the meaning set forth in the first paragraph of this Note.

Prior Note means the Revolving Credit Note dated February 19, 1997 made in the principal amount of $10,000,000 by Borrower payable to Bank.

Prior Note means the convertible promissory note in the original principal amount of $1,200,000 (designated as Note No. HLBZ-12) issued by the Company to the Holder on August 25, 2023.
