Private Streets definition

Private Streets means subdivision streets that have not been dedicated to public use or that require the permission or invitation of a resident or owner to use the street. Such streets are not intended to be included in the secondary system of state highways maintained by the department.
Private Streets means the private street, as indicated on the SDP, that will be transferred in favour of the Association or Sub-Association, as the case may be, in the Cape Town Deeds Registry, which will become the responsibility of the Association or the relevant Sub-Association;

OWNER, in consideration for being permitted by the POA to operate his/her GOLF CART or NEV on the PRIVATE STREETS within Bentwater, ▇▇▇▇▇▇ agrees to abide by all terms of this Agreement: OWNER acknowledges and represents that his/her NEV is titled and registered with the State of Texas to drive on public streets. NEVs that are not titled and registered with the State of Texas must conform to the requirements set forth herein regarding Golf Carts. Proof of title and registration is attached as Exhibit A and incorporated by reference herein. OWNER acknowledges and represents that his/her GOLF CART meets the standard requirements as to condition and appearance as set out in the Bentwater Country Club Private Cart Agreement, as may be amended from time to time, including but not limited to: • Golf Carts will not have the ability to seat more than four adult passengers. • Golf carts shall be clean, paint in good condition, and generally have a good appearance. Golf carts must have the appearance of a generic golf cart and not an appearance similar to a car or other vehicles or portions thereof. • Golf carts must be in good mechanical condition. • It is mutually agreed that the only type of golf cart permitted to be owned or leased in accordance with this license shall be a white, four-wheel E-Z-Go, Club Car, Sky/Star or Yamaha electric low-pressure tire golf cart, and it is required that each privately-owned or leased cart bear a numbered decal for purposes of identification. • Permitted golf carts must be maintained in good condition throughout the term of this permit and may be inspected from time to time to confirm its condition. • Permitted golf carts that are not in good condition and cannot pass the requirements for a country club licensed cart, or carts that have been damaged by accident and have not been repaired may not be operated on streets or other common areas. • Any permitted golf cart shall be identified by number (decals) placed on the golf cart at the time of permitting. In addition to the applicable section above, OWNER agrees to the following:

Private Streets means those two streets identified on the Plat as W. Riversedge Lane (the northerly Private Street) and W. Laguna Shore Lane (the southerly Private Street), and the Shared Driveway. The southerly private street is not a separate lot; rather, it is part of an easement that encumbers Lots 10, and 25-34, Block 1 of the Development. The Private Streets are for the use and benefit of the Residential Lots that front on said Private Streets; the Association for maintenance purposes; and any utilities that utilize the easement of the Private Streets. The Private Streets are not part of the Common Areas.
