Probable cause cases are forwarded to a public hearing before an administrative law judge.
Probable cause for justifying the issuance of an administrative inspection warrant may be based on either specific evidence to support a reasonable belief that a violation has been or is being committed, or a showing that reasonable legislative or administrative standards for conducting an inspection are satisfied for an establishment.
Probable cause may not be established, and thus not a basis for testing, if it is based solely on the observations and reports of third parties.
Police officials may enter school property or a school function to question or search a student or to conduct a formal investigation involving students only if they have:• A search or an arrest warrant; or• Probable cause to believe a crime has been committed on school property or at a school function; or• Been invited by school officials.
