Product Specific Patent definition

Product Specific Patent means any Patent owned by Ambrx (or any Ambrx Affiliate) that specifically Covers the composition, formulation, method of use and/or method of manufacture of any Compound and/or Product. As of the Effective Date, the Product Specific Patents consist of the Ambrx Patents listed in Exhibit D.
Product Specific Patent means a Patent filed during or after the Research Term, that (a) claims (i) a Compound, Product or Project Target or (ii) a method of making or using a Compound or Product, wherein in either case (clause (i) or (ii)), such claim of such Patent includes Specific Identification of the relevant Compound, Product or Project Target or (b) contains a claim that includes a genus that identifies a Compound, Product or Project Target, or a method of making or using a Compound, Product or Project Target.
Product Specific Patent means any Patent (including all claims and the entire scope of claims therein) Controlled as of the Effective Date or thereafter during the Term by CytomX (or any CytomX Affiliate) (including CytomX’s interest in any Joint Patents) that specifically Covers the composition, formulation, or method of use of any Compound and/or Product, but does not cover any other subject matter, such as Probodies against targets other than Collaboration Targets. Examples of Product Specific Patent in a sentence

  • Without the prior written consent of the other Party (not to be unreasonably withheld, conditioned or delayed), neither Party will settle any Product Specific Infringement Action in any manner that would adversely affect a Product Specific Patent or that would limit or restrict the ability of BMS (or its Affiliates or Sublicensees, as applicable) to sell Products anywhere in the Territory.

  • An Ex-US Product Specific Patent shall not become a Joint Patent or a BMS Patent by reason of the assignment contemplated by this Section 7.8, and shall at all times remain an Ambrx Patent which is a Product Specific Patent.

More Definitions of Product Specific Patent

Product Specific Patent means any NewLink Patents and Collaboration Patents (including any Collaboration Patents owned or co-owned by NewLink) in which [*] to the [*] and [*]. Notwithstanding anything to the contrary herein, all [*] are deemed Product-Specific Patents.
Product Specific Patent has the meaning set forth in Section 8.2.2.

Product Specific Patents will also include patents and pending patent applications that are divisionals or are otherwise direct continuations of any Product Specific Patent. Claims within the scope of item (ii), subparts (a), (b) and (c) are “Product Specific Claims.”
