Product Specific Patent definition

Product Specific Patent means any Patent owned by Ambrx (or any Ambrx Affiliate) that specifically Covers the composition, formulation, method of use and/or method of manufacture of any Compound and/or Product. As of the Effective Date, the Product Specific Patents consist of the Ambrx Patents listed in Exhibit D.

Product Specific Patent means any Patent (including all claims and the entire scope of claims therein) Controlled as of the Effective Date or thereafter during the Term by CytomX (or any CytomX Affiliate) (including CytomX’s interest in any Joint Patents) that specifically Covers the composition, formulation, or method of use of any Compound and/or Product, but does not cover any other subject matter, such as Probodies against targets other than Collaboration Targets. Product Specific Patent means a Patent that consists solely of claims specifically directed to (i) the composition or formulation of a particular Licensed Product, or (ii) any method of using, making or administering a particular Licensed Product. For avoidance of doubt, a Product-Specific Patent may not include any claims relating to a Binder, including any method of using, making or administering a Binder, other than as part of a particular Licensed Product or for use solely in the Field.

Examples of Product Specific Patent in a sentence

• Further, Lilly’s election not to defend against patent oppositions existing as of the Effective Date shall not prevent Lilly from exercising any of the remaining rights to Prosecute and Maintain any Product-Specific Patent that it wishes to control in accordance with this Agreement.

More Definitions of Product Specific Patent

Product Specific Patent means a Patent filed during or after the Research Term, that (a) claims (i) a Compound, Product or Project Target or (ii) a method of making or using a Compound or Product, wherein in either case (clause (i) or (ii)), such claim of such Patent includes Specific Identification of the relevant Compound, Product or Project Target or (b) contains a claim that includes a genus that identifies a Compound, Product or Project Target, or a method of making or using a Compound, Product or Project Target.

Product Specific Patent means any Arcturus Patent or Joint Patent that claims: (i) the composition or formulation of a Collaboration Compound; or (ii) any method of using or making a Collaboration Compound. Notwithstanding the foregoing, Product-Specific Patents shall exclude any Arcturus Patent or Joint Patent that claims:

Product Specific Patent means any NewLink Patents and Collaboration Patents (including any Collaboration Patents owned or co-owned by NewLink) in which [*] to the [*] and [*]. Notwithstanding anything to the contrary herein, all [*] are deemed Product-Specific Patents.

Product Specific Patent has the meaning set forth in Section 8.2.2.

Product Specific Patent means, with respect to a Collaboration Program, any Patent (including all claims and the entire scope of claims therein) within the Lyell Patent Rights that (a) Covers only the composition of matter or formulation of, or method of making or using, one or more Collaboration Anti-Exhaustion Components as incorporated into one or more Products, and (b) does not Cover subject matter other than that described in (a).

Product Specific Patent has the meaning set forth in Section 12.5(a)(iii).

Product Specific Patent means any Patent Controlled as of the Effective Date or thereafter during the Term by Ambrx (or any Ambrx Affiliate) containing one or more claim Covering the composition of matter, formulation, method of use and/or method of manufacture of any Compound and/or Product, where such claim recites (or otherwise includes by reference) the identity of a Collaboration Target and/or the amino acid sequence (or coding nucleotide sequence) of a Compound (where such sequence includes sequences providing specificity of the Compound for the applicable Collaboration Target). As of the Effective Date, the Product Specific Patents consist of the Ambrx Patents listed in Exhibit D hereto. For avoidance of doubt, a Patent shall not be considered to be a Product Specific Patent based on any generic claim that Covers methods of manufacturing Antibodies generally without reference to a Collaboration Target or Compound.
