Public Ways definition

Public Ways or “Public Rights-of-Way” means the areas in, upon, above, along, across, under, and over the public streets, sidewalks, roads, lanes, courts, ways, alleys, boulevards, buildings and any other public places owned by and within the CITY as the same now or may hereafter exist and which are under the permitting jurisdiction of the CITY .
Public Ways means streets, roads, and ways that are recorded in the Registry of Deeds, defined by metes and bounds, and are available for use by the general public. Such ways may be owned by the state or a municipality, or they may be privately owned by Customer(s). Similarly defined and recorded rights-of- ways located on or across Private Property may also be acceptable for the purpose of the Company to install, own, and maintain a Line Extension.
Public Ways means the present and future streets, avenues, boulevards, parkways, lanes, alleys, bridges, sidewalks, parks, easements, highways, and any other public place within the municipal corporate limits of the City, whether dedicated or not.

  • All transmission and distribution structures, poles, other lines, and equipment installed by the Franchisee for use in the Cable System in accordance with the terms and conditions of this Franchise Agreement shall be located so as to minimize the interference with the proper use of the Public Ways and the rights and reasonable convenience of property owners who own property that adjoins any such Public Way.


More Definitions of Public Ways

Public Ways means the area on, below, or above any real property in City in which the City has an interest including, but not limited to any street, road, highway, alley, sidewalk, parkway, park, skyway, or any other place, area, or real property owned by or under the control of City, including other dedicated Rights-of-Way for travel purposes and utility easements.
Public Ways means all dedicated public rights-of-way, streets, highways, and alleys of the Franchisors. “Public Ways” shall not include property of Franchisors which is not a dedicated public right-of-way, street, highway, or alley.
Public Ways means any street, alley, avenue, boulevard, lane, park, parkway, sidewalk, driveway, utility easement, public right of way, and any other public ways, places, areas, or grounds within the municipal corporate limits of the City as now constituted or as may be added or extended hereafter.
Public Ways means the surface of, and the space above and below, any public street, highway, bridge, alley, sidewalk, parkway, or other public right­of­ way, including, but not limited to public easement, dedicated strip, or public right-of-way now or hereafter held by the City and dedicated for compatible uses that, within its proper use and meaning, and consistent with the terms, conditions and provisions pursuant to which the same was created or dedicated, properly is used by Grantee for the purpose of installing, maintaining and operating the Gas Utility System.
Public Ways means land acquired or dedicated for public roads and streets, but does not include: (1) State highways; (2) Land dedicated for roads, streets, and highways not opened and not improved for motor vehicle use by the public; (3) Structures, including poles and conduits, located within the right-of-way; (4) Federally granted trust lands or Forest Board trust lands; (5) Lands owned or managed by the State Parks and Recreation Commission; or (6) Federally granted railroad rights-of-way acquired under 43 USC 912 and related provisions of federal law that are not open for motor vehicle use. Public Ways for the purpose of this Franchise do not include: (i) buildings, other City-owned physical facilities, parks, fixtures, real property or property rights owned by the City, or similar facilities or property owned by or leased to the City, including, by way of example and not limitation, structures in the
Public Ways means the surface, the air space above the surface and the area below the surface of any right-of-way and public street and any highway, lane, path, alley, sidewalk, b▇▇▇▇▇▇▇▇, ▇▇▇▇▇, ▇▇▇▇▇▇, ▇▇▇▇, ▇▇▇▇▇▇▇, waterway or other public right-of-way including public utility casements or rights-of-way in which the city has jurisdiction, and any temporary or permanent fixtures or improvements located thereon now or hereafter held by the City in which the City holds rights sufficient, without consent of any other party, to permit Grantee to use thereof for the purpose of installing or maintaining Grantee’s District Cooling Facilities. The term “Public Ways” shall be deemed not to include Chicago Freight Tunnels or the LaSalle Street Trolley Tunnel or any other tunnels except as specifically referred to herein.
