If Lessor declines or fails timely to deliver a Recapture Notice, Lessor shall have no further right under this Section 11.06 to the Recapture Space unless it becomes available again after transfer by Lessee.
If the Airline’s Gate Utilization does not meet or exceed the Utilization Threshold within one hundred twenty (120) days after the Initial Recapture Notice, the CEO will send the Airline a written notice (the “Final Recapture Notice”) terminating the Airline’s lease of the portion of its Airline Premises subject to reassignment as of the date specified in the Final Recapture Notice.
A timely Recapture Notice terminates this Lease for the Recapture Space, effective as of the date specified in the Transfer Notice.
