Section 34173(h) of the Dissolution Act authorizes the City to “loan or grant funds to [the Successor Agency] for administrative costs, enforceable obligations, or project-related expenses at the [City's] discretion, but the receipt and use of these funds shall be reflected on the Recognized Obligation Payment Schedule or the administrative budget and therefore are subject to the oversight and approval of the oversight board.
Pursuant to Section 34177 of the Health and Safety Code, not less than 90-days prior to each January 2 and June 1 (or such other dates as are specified in the Health and Safety Code or other applicable law), the Agency shall prepare and submit to the Oversight Board and the State Department of Finance, a Recognized Obligation Payment Schedule, pursuant to which enforceable obligations of the Agency are listed including, with respect to the Loan and any outstanding Parity Debt.
Pursuant to the Dissolution Act, the Successor Agency prepares and submits a Recognized Obligation Payment Schedule (“ROPS”) for each six-month period (January 1 through June 30 and July 1 through December 31), and includes on each ROPS the estimated payments to be made by the Successor Agency for each enforceable obligation during each applicable six-month ROPS period.
Use of the Loan proceeds shall be listed on the Successor Agency’s Recognized Obligation Payment Schedule.
