Regulatory Fees which are so paid and discounted shall not be subject to any retroactive adjustment based on the prior year’s estimate having been over the actual costs of regulation.
If the previous year’s Regulatory Fee exceeded the SGA’s actual cost of regulation, any excess which was paid will be applied as a credit to the payment of Regulatory Fees in such next year.
Other than as may be provided in connection with a negotiated fee, Regulatory Fees may be paid for an entire year in advance of the date on which the billing year commences, or within 45 days of being notified of the forthcoming year’s Regulatory Fee, whichever last occurs, in which event the Tribe shall receive a 10% discount.
