Relevant Investor definition
Relevant Investor means, in respect of each Warrant of the relevant Series, an institutional investor which, for the avoidance of doubt, may include the Issuer and/or its affiliates, as determined by the Calculation Agent, with the ability to place orders and/or trade the Underlying Asset for such Series through the China Connect Service.
Relevant Investor means a hypothetical investor in Fund Shares that is a large European investment bank and which is deemed to have the benefits and obligations, as provided in the Fund Documents, of an investor holding Fund Shares at any relevant time.
Relevant Investor means a hypothetical or actual investor (as determined by the Index Administrator in the context of any relevant situation) in Fund Shares, which is deemed to have the benefits and obligations, as provided in the Fund Documents, of an investor holding Fund Shares at any relevant time. The Relevant Investor may be deemed by the Index Administrator to be resident or organised in any jurisdiction, and to be, without limitation, the Index Administrator, the Index Administrator and/or any Hedge Provider (as determined by the Index Administrator (acting reasonably) in the context of any relevant situation) and, in the determination of the Index Administrator, to have the benefit of any agreement or arrangement between the issuer, counterparty or obligor in respect of any Financial Product and/or any Hedge Provider, the Fund and/or any service provider of the Fund relating to the subscription and/or redemption of Fund Shares.

In the event of a sale or deemed sale by the Relevant Investors of less than 100% of the Relevant Investor Shares, for purposes of determining Realized Cash, the Relevant Investors will be deemed to sell such shares on a “first in, first out” basis.
For the avoidance of doubt, a distribution of Relevant Investor Shares by a Relevant Investor to its investors shall not be treated as a sale by such Relevant Investor.
All decisions by the Committee with respect to any calculations pursuant to Section 3 and Section 4, including, without limitation, the determination of Realized Cash, Total Investor IRR, Total Invested Capital, Relevant Investor Investment and the date, if any, that Realized Cash exceeds any of the applicable targets, shall be reasonable and made in good faith and, absent manifest error, shall be final and binding on the Participant.

Relevant Investor means a hypothetical or actual investor (as determined by the Calculation Agent (acting reasonably) in the context of any relevant situation) in Fund Shares, which is deemed: (a) to have the benefits and obligations, as provided in any relevant Fund Information Document, of an investor holding Fund Shares at any relevant time; (b) in the case of any subscription for Fund Shares, to have submitted a valid and duly completed subscription notice and to have paid subscription monies to the Fund, on or before the last date on which it would be permitted, according to the Fund Information Document, to submit a subscription notice and subscription monies that would be timely for a subscription in respect of any relevant amount of Fund Shares in respect of any relevant Valuation Date; and (c) in the case of any redemption of Fund Shares, to have submitted a valid and duly completed redemption notice on or before the last date on which it would be permitted, according to the Fund Information Document, to submit a redemption notice that would be timely for a redemption in respect of any relevant amount of Fund Shares in respect of any relevant Valuation Date. The Relevant Investor may be deemed by the Calculation Agent to be resident or organised in any jurisdiction, and to be, without limitation, the Issuer (as determined by the Calculation Agent (acting reasonably) in the context of any relevant situation); and
Relevant Investor means, in respect of each Warrant of the relevant Series, a corporate entity incorporated in the State of New York and tax resident in the United States of America (which, for the purposes of the definitions of "Dividend Taxes" and "Dividend Amount" only, shall be deemed to hold less than one per cent. of the Shares in issue at the relevant time).

The Relevant Investor may be deemed by the Index Calculation Agent to be resident or organised in any jurisdiction, and to be, without limitation, the Index Sponsor, the Index Calculation Agent, any Hedging Counterparty and/or any Hedge Provider (as determined by the Index Calculation Agent (acting reasonably) in the context of any relevant situation) and, in the determination of the Index Calculation Agent, to have the benefit of any agreement or arrangement between the issuer or obligor of a Financial Product, any Hedging Counterparty and/or any Hedge Provider, that Underlying Fund and/or any service provider of that Underlying Fund relating to the subscription and/or redemption of Fund Interest Units.
