Replacement Product is warranted only for the balance of the warranty on the original Product.
As of January 1 of each succeeding year, Seller may elect to amend the amount of the Performance Assurance to an amount equal to ten percent (10%) multiplied by the Annual Contract Quantity multiplied by the Contract Price (or Replacement Product, as applicable) multiplied by the number of years remaining in the Term.

Buyers shall, or shall cause Buyers’ designee, to maintain, and the Authorized Auditors of Seller shall have access to, all records and data pertaining to the Scheduling of Facility Energy, Capacity, and Replacement Product.
