Any Request for Change Order involving Subcontractor-performed Maintenance Services that is not accompanied by such analysis and certification shall be considered incomplete.
The first Request for Change Order shall be labeled “Request for Change Order No. 1” and subsequent RCOs shall be numbered sequentially.
Each incomplete Request for Change Order shall: (a) include a list of those Change Order requirements that are not fulfilled together with an explanation satisfactory to TxDOT stating why such requirements cannot be met and (b) in all events include sufficient detail to ascertain the basis for the proposed Change Order and for any Maintenance Price increase associated therewith, to the extent such amount is then ascertainable.
DB Contractor shall initiate the Change Order process by delivery of a PCO Notice as described in Section 4.5.5.2, followed by submittal of a Request for Change Order and supporting documentation to TxDOT.
DB Contractor shall deliver a Request for Change Order under this Section 4.5.6.1 to TxDOT within 30 days after delivery of the PCO Notice or within 10 Business Days after receipt of TxDOT’s determination to require a Request for Change Order in accordance with Section 4.5.4.1.3, whichever is applicable.
