Employee further agrees not to use or disclose to any Person (other than any member of the Company Group) any contact information, including the names, addresses, and work or personal telephone numbers, for any Restricted Service Provider in association with or in furtherance of any Prohibited Solicitation of a Restricted Service Provider.
Any such new service that is a Restricted Service when requested by Recipient will be included within the scope of Services offered to Recipient under this Agreement when such service ceases to be a Restricted Service.
Accordingly, in the event that the Service Provider fails to meet any prescribed Service Levels, then in addition to all other remedies available to SARS in law, SARS may report the Service Provider to National Treasury and request that such Service Provider be placed on National Treasury’s List of Restricted Service Providers.
Upon the earlier of (i) the date that is six (6) months after the first launch of a particular Restricted Service or (ii) the date on which any of the above conditions ceases to be true, the applicable service shall cease to be a Restricted Service, and the Recipient Parties will then and thereafter have the right to receive such service in accordance with the terms of this Agreement.
This Section 3.6 shall not apply to a Restricted Service so long as it remains a Restricted Service.
