Restructuring Support Agreement definition

Restructuring Support Agreement has the meaning set forth in the Recitals.

Restructuring Support Agreement means the Restructuring Support Agreement dated June 30, 2020 appended as Exhibit B to the Declaration of Eric Koza in Support of Debtors’ Chapter 11 Petitions and First Day Relief filed in the Chapter 11 Cases (Docket No. 4).

Restructuring Support Agreement means that certain Restructuring Support and Lock-Up Agreement, dated as of May 11, 2016 (as amended, restated, amended and restated, supplemented or otherwise modified from time to time prior to the date hereof), by and among the Loan Parties signatory thereto, the Lenders thereto, certain other holders of claims and interests and the other Persons party thereto.

• Pursuant to section 510 of the Bankruptcy Code, and subject to the Restructuring Support Agreement, the Reorganized Debtors reserve the right to re-classify any Allowed Claim or Allowed Interest in accordance with any contractual, legal, or equitable subordination relating thereto.

Restructuring Support Agreement means that certain Restructuring Support Agreement, made and entered into as of April 14, 2020, including all exhibits thereto, by and among the Debtors and the Consenting Noteholders party thereto from time to time, as such may be amended from time to time in accordance with its terms.
