The Retainage Amount must be paid to Contractor within thirty (30) business days after the City’s final acceptance of the portion of work for which a separate price is stated in the specifications for the Project.
Upon the final completion of the Contract Work, any remaining portions of the Retainage Amount shall be returned to Tenant and Landlord shall assign to Tenant all warranties and guaranties of Walenrelated to the Contract Work, which assignment shall be on a nonexclusive basis such that the warranties and guarantees may be enforced by Landlord and/or Tenant, and Tenant hereby waives all claims against Landlord relating to, or arising out of the design and construction of, the Contract Work.
This provision does not prevent the Contractor from seeking withdrawals of the Retainage Amount in excess of One Thousand Dollars ($1,000), pursuant to the requirements of §18-1-301, MCA.
Concurrent with the execution of this Agreement, the Seller and Buyers shall execute the Retainage Agreement (the "Retainage Agreement") which includes the terms and conditions pursuant to which Buyers will deposit the Retainage Amount at Closing.
Landlord may, but shall not be obligated to, use a portion of the Retainage Amount to pay any amounts owed by Tenant that are not paid when due (in which event Tenant shall deposit with Landlord such portion of the Retainage Amount used by Landlord within ten (10) business days of written request).
