Rights to Equipment definition

Rights to Equipment means the Private Partner’s rights to the Equipment, including the right of ownership and/or use (lease) of the Equipment. "Right to Facility" – the Private Partner’s rights to the Facility, including the right of ownership and/or use (lease) of the Equipment. "Government Intervention" - one (any) or several of the following circumstances: requisition, nationalization or seizure of the Project and/or the Private Partner (including shares of the Private Partner, the Facility and (or) any or all Equipment and/or other Project Assets) by the Public Partner or other public authority of the KR; any act or inaction of the Public Partner or any other public authority of the KR, which discriminates or has disproportionate impact on the Project and/or the Private Partner in comparison with similar projects in the KR and having material and negative financial influence on the Project and/or the Private Partner; and intervention of the Public Partner and/or other public authority of the KR into the business activity of the Private Partner, significantly hindering performance by the Private Partner of its obligations under this Agreement "Terminating Party" - has the meaning given to it in article 21.6.1. "Applicable Permissions" - licenses (including the License), certificates, permits, approvals and all other permissions listed in Annex 2, which are required for the Private Partner and/or its Personnel for the Project implementation. "Project" – has the meaning given to it in the preamble to the Agreement. "Project Investments" - has the meaning given to it in article 13. "Reorganization" - means reorganization (corporate restructuring) of the Private Partner as defined in article 92 of the Civil Code of the Kyrgyz Republic. "Environmental and Social Risk Management System" - means the Private Partner’s environmental and social risk management system developed and maintained in accordance with article 12.1. "Agreement" - has the meaning given to it in the preamble to the Agreement. "Facility Creation" - has the meaning given to it in article 5.1. "Dispute" - has the meaning given to it in article 22.2. "Agreement Validity Period" - has the meaning given to it in article 3.2.1. "Insurance" - has the meaning given to it in article 11.2. "Tender" - has the meaning given to it in the preamble to the Agreement. Related to Rights to Equipment

  • Standard equipment means the basic configuration of a vehicle which is equipped with all the features that are required under the regulatory acts of the Contracting Party including all features that are fitted without giving rise to any further specifications on configuration or equipment level.

  • Systems and Equipment means any plant (including any central plant), machinery, transformers, duct work, cable, wires, and other equipment, facilities, and systems designed to supply heat, ventilation, air conditioning and humidity or any other services or utilities, or comprising or serving as any component or portion of the electrical, gas, steam, plumbing, sprinkler, communications, alarm, lab, security, or fire/life safety systems or equipment, or any other mechanical, electrical, electronic, computer or other systems or equipment which serve the Building and/or any other building in the Project in whole or in part.

  • Designated Equipment means any equipment designated in the SLA, upon which the Licensed System may be used; Documentation means operating manuals and other printed materials which assist the Customer to use the Licensed System including any technical and user software material as published by Pentana Solutions; Escalation Request is as set out in the SLA;

  • Additional Equipment means equipment that is not factory fitted in the Vehicle, including but not limited to navigation equipment (GPS), baby seat, bicycle rack etcetera;

  • Farm equipment means equipment used directly for farming

  • Covered Equipment means, unless otherwise specified in a Schedule, Covered Property:

  • Third Party Equipment has the meaning given such term in Section 4.8 of this Agreement.

  • Replacement Equipment means operational equipment or other parts used by Tenant to replace any of the Equipment.

  • New equipment means equipment for which, by the cut-off date, neither of the following events has occurred:

  • Machinery and equipment shall have the meaning specified in Section 1.1(c).

  • X-ray equipment means an x-ray system, subsystem, or component thereof. Types of x-ray equipment are as follows:

  • Optional equipment means all the features not included in the standard equipment which are fitted to a vehicle under the responsibility of the manufacturer, and that can be ordered by the customer.

  • BT Equipment means any equipment, including any Software, owned by or licensed to BT Group that is located at a Site for the provision of a Service.

  • Accessory equipment means any equipment associated with the installation of a wireless telecommunications facility, including but not limited to cabling, generators, fans, air conditioning units, electrical panels, equipment shelters, equipment cabinets, equipment buildings, pedestals, meters, vaults, splice boxes, and surface location markers.

  • Licensee Improvements means any enhancement to or modification or improvement of the Licensed Patents and/or the Proprietary Information created by or on behalf of Licensee and/or any of its subsidiaries.

  • Existing Equipment means any items of existing plant or equipment owned or controlled by either Pur- chaser or End-User upon which Supplier is required to perform Services.

  • Supplier Equipment means the Supplier's hardware, computer and telecoms devices, equipment, plant, materials and such other items supplied and used by the Supplier (but not hired, leased or loaned from the Customer) in the performance of its obligations under this Call Off Contract;

  • Fixtures and Equipment means, with respect to any Person, all of the furniture, fixtures, furnishings, machinery and equipment owned or leased by such Person and located in, at or upon the Assets of such Person.

  • Qualified machinery and equipment means all new industrial

  • Computer equipment means Covered Property that is electronic computer or other data processing equipment, including peripherals used in conjunction with such equipment, and electronic media and records.

  • Excluded Equipment means (i) defibrillators, enhanced emergency medical kits and other medical equipment, (ii) airphones and other components or systems installed on or affixed to the Airframe that are used to provide individual telecommunications or electronic entertainment to passengers aboard the Aircraft, (iii) galley carts, beverage carts, waste containers, liquor kits, food tray carriers, ice containers, oven inserts, galley inserts, and other branded passenger convenience or service items, (iv) any items, equipment or systems leased by Company or any Permitted Lessee (other than items, equipment, or systems that are leased from Company pursuant to the applicable Lease) or owned by Company or any Permitted Lessee subject to a conditional sales agreement or a security interest (other than the security interest granted under the Indenture), and (v) cargo containers.

  • Leased Equipment means the computers, servers, machinery and equipment and other tangible personal property leased by Seller for use in the operation or conduct of the Business.

  • Purchased Equipment means any equipment, including any Software, sold by BT to the Customer.

  • Customer Equipment means hardware, software, systems, cabling and facilities provided by you and used in conjunction with the Equipment that we supply to you in order to receive the Services;

  • Plant and Equipment means permanent plant, equipment, machinery, apparatus, articles and things of all kinds to be provided and incorporated in the Facilities by the Contractor under the Contract (including the spare parts to be supplied by the Contractor under GCC Sub-Clause 3.3 hereof), but does not include Contractor’s Equipment.

  • Substitute Improvements means the substitute or additional improvements of the Issuer described in Article V hereof.
