Roche Patents definition

Roche Patents means Patents included within the Roche Patent Rights.
Roche Patents means any Patent Rights that (i) did not arise in connection with the performance of an R&D Plan, (ii) are owned, used, developed by, or licensed to Roche or its Affiliates, and (iii) are necessary or useful to Develop, Manufacture or Commercialize a Product in the Field, in each case to the extent Controlled by Roche or its Affiliates on the Effective Date or at any time during the Agreement Term.
Roche Patents means, to the extent Controlled by Roche as of the Effective Date or during the Development Term, all Patents that claim inventions necessary for performance of the Development Program or that claim the manufacture, use, sale, offer for sale or import of any Product, but excluding the Emisphere Patents licensed to Roche hereunder and the Joint Patents.

  • Any and all settlements that restrict the scope or enforceability of Joint Roche-PDL Patents or Sole Roche Patents (other than those Sole Roche Patents co-owned by a Third Party) must be approved by PDL before execution by Roche, such approval not to be unreasonably withheld.

  • Pharmasset shall cooperate with and assist Roche in the enforcement of the Roche Patents upon the reasonable request of Roche, including joining as a party to any enforcement action, provided, however, that Roche shall reimburse Pharmasset for its reasonable litigation expenses (including legal fees charged by Pharmasset’s independent counsel, not including any internal costs associated with activities performed by Pharmasset employees).

  • With respect to the Roche Know-How and Roche Patents to which Roche or its Affiliate has a non-exclusive license, the license set forth in Section 2.2(a) shall be a sole, non-exclusive license.

  • In addition, contingent upon such termination, Roche hereby grants to Gilead an exclusive, royalty-free license under the Roche Patents and the Roche Know-How which are necessary or useful for the manufacture, use or sale of the Product(s) as such product(s) exist as of the date of termination.

  • Roche hereby covenants that it will not grant to any Third Party any right or license, under (i) the Roche Know-How and Roche Patents to which Roche or its Affiliate has a non-exclusive license or (ii) the Roche Know-How and Roche Patents that Roche or its Affiliate jointly owns, to develop, use, manufacture, have manufactured, market, promote, import, offer for sale and sell Daclizumab in the Field and in the Territory.


More Definitions of Roche Patents

Roche Patents means all patent applications owned or Controlled by Roche or its Affiliates (“Sole Roche Patents”) alone or with a Third Party, and all Joint Roche-PDL Patents claiming Licensed Products or their manufacture or use in the Asthma Field, which are filed prior to or during the term of this Agreement in the U.S. or any foreign jurisdiction, including any addition, continuation, continuation-in-part or division thereof or any substitute application therefor; any patent issued with respect to such patent application, any reissue, extension or patent term extension of any such patent, and any confirmation patent or registration patent or patent of addition based on any such patent; and any other U.S. or foreign patent or inventor’s certificate covering Licensed Products in the Asthma Field.
Roche Patents means all Patents owned by or licensed to Roche as of the Effective Date or during the Term.
Roche Patents means NEKTAR PATENT RIGHTS (as defined in Clause 1.17 of the Roche License Agreement), to the extent included in the Roche Intellectual Property Rights.
Roche Patents means the Patents or Patent Rights Controlled by Roche as exhaustively listed in Appendix 2 of this Agreement, along with all Patents and Patent Rights that claim priority to one or more of such Patents or Patent Rights so listed in such Appendix 2.
Roche Patents means (i) any Patents which Roche or its Affiliates, prior to or during the Research Term, owns or controls (provided that Roche or its Affiliates has the right to license or otherwise make available such Patents to deCODE) which relate to any of the Research Projects or are necessary to make, have made, use, offer for sale, sell or import Products, or (ii) any Program Patent which Roche or its Affiliates solely owns or controls; provided however, that "Roche Patents" specifically excludes Roche's and its Affiliates' patent portfolio relating to PCR technology.
Roche Patents means (a) any patent application filed on an Invention assigned to Roche by PacBio pursuant to Section 10.1(c)(i) (a “PacBio-Assigned Improvement”), (b) any Foreground Technology owned by Roche or its Affiliates pursuant to Section 10.1(b) (other than Roche-Assigned Improvements), and (c) all Patents Controlled by Roche or its Affiliates.
Roche Patents mean the rights conferred upon Roche from the patents and patent applications owned and/or controlled by Roche, both foreign and domestic, covering inventions resulting from the Research Program including those inventions which are directed to or result from using the Initial Identified Target and any Additional Target licensed by Roche under Section 5.1 and which inventions were made during the course of Research Program and for five (5) years thereafter.
